From the Morganton News-Herald (4/19/10): One lawsuit filed in 2009 against the Burke County Board of Education will be dismissed, but local attorney Stephen Schoeberle is going ahead with a second.
Schoeberle voluntarily asked Superior Court officials to dismiss the lawsuit he filed on May 22 and subsequently amended at least three times with additional complaints. The suit tried to force the school board to move its meetings to places and times when more people could attend.
The second lawsuit, currently set for a Superior Court hearing Aug. 23, concerns Americans’ fundamental right to free speech — the Constitution’s First Amendment that a majority of the school board rejected on a 2-4 vote last year.
