Elon law professor quoted by HuffPost about NC Democratic Party complaint

The associate professor of law gave his perspective on an employee retaliation complaint against the North Carolina Democratic Party.

Eric Fink, associate professor of law at Elon University, was recently quoted by HuffPost in a story about a complaint against the North Carolina Democratic Party (NCDP)

According to HuffPost, the NCDP is accused of moving up the termination date of an employee as retaliation by a female supervisor whom the employee had a relationship with. HuffPost reports that the worker was offered a severance agreement in exchange for silence about the agreement’s term.

Fink, who specializes in civil procedure, professional responsibility and employment law said the employee would have a “pretty strong retaliation claim.” He also advises companies to go beyond what is strictly required by law.

“The best practice for the employer would be to at least pursue the complaint, investigate the complaint … as opposed to just paying people to be quiet and go away,” said Fink, who was not speaking from knowledge about whether an investigation occurred.
